Abstract
Discusses what the applicable case law reveals about the meaning of "cohabitant" as defined by the Family Law (Scotland) Act 2006 s.25. Notes the three factors outlined by s.25 in terms of determining whether a couple has lived as though in a formalised relationship, namely: (1) the length of the period during which the couple have lived together; (2) the nature of their relationship during that period; and (3) the nature and extent of any financial arrangements subsisting, or which subsisted, during that period.
