Abstract
Discusses the enforcement of missives in Scotland, highlighting instances where a purchaser cannot pay when their own property does not sell. Considers the seller's implied obligations including those to deliver or to exhibit a valid marketable title regarding express stipulations in missives, on enforcement to gain entry to the subjects usually with vacant possession, to deliver a valid disposition, and to implement other obligations in the missives. Examines purchaser's obligations, particularly the payment of the price. Outlines the basic remedies for breach of contract.
