Abstract

Examines the implications, for the Scottish law doctrine of prescription, of the European Court of Human Rights ruling in JA Pye (Oxford) Ltd v United Kingdom (44302/02) on whether the claim to possession of land under the English law of adverse possession breached the right to peaceful enjoyment of possessions under the European Convention on Human Rights. Notes the course of proceedings in the English courts and in the European court, the justification given for applying limitations and the issues of public interest.
