Abstract

This is a review of Felix Bieker’s book published in 2022: The Right to Data Protection: Individual and Structural Dimensions of Data Protection in EU Law, which calls for a reconsideration of the independent, structural, and societal value of the right to data protection. The book review outlines how Bieker develops a dualistic approach to differentiating the EU right to data protection and the right to privacy centring on inherent risk and power imbalance from both individual and structural dimensions. The review evaluates Bieker’s book by highlighting how he interprets a narrow concept of privacy that serves the narratives and the black-letter approach that facilitates the reconstruction of the two-dimension EU data protection law.
