Abstract
The aim of this paper is to study the legal implications arising from the volunteer recruitment of children in terrorist armed groups in terms of determining the criminal responsibility of those who recruit children as well as the criminal responsibility of the children themselves in case they commit international crimes or violations of the rules of international humanitarian law. A determined by the statute of the International Criminal Court, the court does not have jurisdiction over those under the age of 18. The question, then, whether the volunteer recruitment of a child would affect his criminal responsibility in term of age limitation. This research also focuses on determining the criminal responsibility of the child for his mere membership in a terrorist group. This responsibility will be examined mainly with reference to the rules of international humanitarian law that requires first determining the existence of an armed conflict and then verifying the extent to which children joining a terrorist group is considered a violation of the rules of this law. The answer to these questions requires defining the meaning of a child soldier and then examining the legal framework for the use of children in armed conflict .
