Abstract

Criticises the "Sentencing Young People" guideline, in force from 26 January 2022, as intensifying the existing anomaly where Scots law is more forgiving of young persons found guilty of criminal wrongdoing than those unintentionally at fault. Discusses the rationale behind the guideline and contracts the approach with the field of delict.
