Abstract

Comments on R. (on the application of Chabloz) v Crown Prosecution Service (DC) on whether a person "causes" a grossly offensive message to be sent by adding a hyperlink to a blog, and whether uploading a video to a video sharing platform server could amount to a communication for the purpose of offences under the Communications Act 2003 ss.127(1)(b) and 127(1)(a). Criticises the court's reasoning in relation to s.127(1)(b) liability.
