Abstract

Highlights the International Centre for the Settlement of Investment Disputes (ICSID) Tribunal decision in ATA Construction Industrial and Trading Co v Jordan on whether the actions of Jordan's courts in annulling the compensation awarded against a Jordanian state-owned company in an arbitration dispute brought by a Turkish company contracted to build a dyke in Jordan constituted a violation of Jordan's obligations under the Jordan-Turkey Bilateral Investment Treaty and a breach of the Turkish company's legal rights under the original contract, entitling it to restitution of the award.
