Abstract

In its decision nº 629/2015, of 17th November, the Spanish Supreme Court fixed its position in relation to the treatment of derivative contracts in insolvency proceedings. Additionally, this was the first time that the Court adopted a teleological interpretation of article 84.2 of the Insolvency Act to prevent the creditor financial institution from benefiting from a super-privileged treatment that is unknown in other European Union jurisdictions. This paper presents a series of reflections on some of the most important aspects of the treatment of derivatives contracts in the context of insolvency proceedings under Spanish law.
