Abstract

The Companies Act 71 of 2008 was assented to on 8 April 2009. The date of commencement of the Act has not yet been proclaimed but it may not come into operation earlier than 9 April 2010 (s 225). Draft Regulations to the Companies Act were published for comment on 22 December 2009 (GN 1664 GG 32832 of 22 December 2009). On 27 July 2010, the Companies Amendment Bill was released electronically (on the web sites of the Department of The Companies Act 71 of 2008 was assented to on 8 April 2009 and took effect on 1 May 2011. It repealed the Companies Act 61 of 1973, except for Chapter XIV (Winding-up of Companies) (see Item 9 of Schedule 5 of the 2008 Companies Act read with section 224(2). The Companies Amendment Act 3 of 2011 was signed into law on 20 April 2011 (see GN 370 in GG 34243 of 20 April 2011). The Regulations and forms under the 2008 Companies Act were published on 26 April 2011 (GN R351 in GG 34239).
