Abstract

In a recent decision, the Russian Patent and Trademark Agency (Rospatent) has granted Anheuser-Busch Breweries the exclusive right to use the name BUD to sell its beer on the Russian market. The victory of Anheuser-Busch, the world's largest brewery, over Czech brewer Budejovicky Budvar represents one chapter in a complex international struggle over the trademarks BUD and BUDWEISER that dates back to 1939.1 The decision is still subject to appeal by Budvar. Nevertheless, Rospatent's ruling on the conflict may prove to be decisive for the American firm, since it largely rejects the Czech company's claims based on the historic connection between the town of Cesky Budejovice — whose German name is Budweis — and its beer.
