Abstract
Explains the changing legal framework regarding real burdens in Scotland, considering how many will continue to be enforceable after the expiry of the 10 year period in 2014. Discusses issues including: (1) the statutory framework, referring to the Title Conditions (Scotland) Act 2003; (2) the role of feudal real burdens; (3) praedial or non-praedial real burdens; (4) the title to enforce; (5) notices of termination; (6) parties with title to enforce a real burden; and (7) the expanded jurisdiction of the Lands Tribunal.
