Abstract

Evaluates the development and effectiveness to date of the Enterprise Act 2002 Pt 6 cartel offence, asking why the only successful prosecution to date has been that discussed by the Court of Appeal in R. v Whittle (Peter), and investigating the failure of the Office of Fair Trading (OFT) prosecution in R. v B, considered by the same court. Assesses the legislation within the policy context provided by the Treaty on the Functioning of the European Union art.101 and Regulation 1/2003, and examines the OFT's report on the failed prosecution.
