Abstract

The article, the second in a three-part series on the Children (Scotland) Bill 2016, considers the proposed introduction of a statutory checklist of factors to be considered in private family law disputes, looking at the arguments for and against its introduction. Considers whether a statutory checklist already exists. Sets out the details of the proposed checklist as it would be introduced under the Children (Scotland) Act 1995 s.11ZA.
