Abstract

Die Europäische Union lässt sich in einem besonderen Maße als „Innovationsverbund“ charakterisieren, der darauf ausgelegt ist, fortwährend rechtliche Innovationen sowohl für die Ebene der Union selbst als auch für die Ebene der Mitgliedstaaten zu generieren. Insofern bilden die Unionsverträge und die durch den EuGH entwickelten Konstitutionsprinzipien des Unionsrechts eine Innovationsverfassung, auf deren Grundlage der Prozess der Integration beständig vorangetrieben werden konnte. Die DNA der Union ist so auf Fortentwicklung angelegt. Umso bedrohlicher sind die momentan zu beobachtenden Innovationsrückschritte und eine gewisse Ratlosigkeit bezüglich der Frage, wie es mit der EU insgesamt weitergehen soll und worin der Prozess der europäischen Integration einmal münden wird und soll. The European Union can be characterized to a special degree as an "innovation network", which is designed to continuously generate legal innovations both at the level of the Union itself and at the level of the Member States. In this respect, the Union Treaties and the constitutional principles of EU law developed by the ECJ form an innovation constitution, on the basis of which the process of integration has been steadily promoted. The DNA of the Union is designed for further development. All the more threatening are the innovation reverses that are currently being observed and a certain amount of perplexity about how the EU as a whole should proceed and what the process of European integration will and should be.
